Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights include:- Pay for all wages earned (INFO # 3) at the rate accepted by the company and staff member.
– Pay of at least base pay (INFO # 1), the relevant Colorado or regional minimum wage, and all earned overtime incomes without impermissible reductions from their wages;.
– Pay of all earned wages without impermissible reductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS enforces a number of Colorado’s wage and hour and other kinds of labor statutes and labor employment rules, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please visit the Division’s Labor Statutes and Labor Rules web pages for existing and prior variations of essential Colorado labor statutes and employment rules.
Published Guidance: The Division’s main types of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, viewpoints, and descriptions on numerous labor law subjects; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If a company owes you incomes, you can send your company a written need for payment of earnings by mail, email, text message, or other electronic means. A written need might be sent out to the company at the same time a Labor Standards Complaint Form for unsettled salaries is filed with the Division. The Labor employment Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements website.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and evaluated, a letter describing the nature of the complaint and employment the amounts declared to be owed is sent out to the company. Investigations Launched by the Division (” Direct Investigations”): The Division might perform employer-wide direct examinations of potential violations of Colorado wage and hour law. If you want to send a pointer, please email the Division at cdle_di_tips@state.co.us. If you wish to submit a specific claim for unpaid salaries, you need to fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or one or more Notices of Assessment, an alleged employer might send a Direct Investigation Appeal Form.
