Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all salaries made (INFO # 3) at the rate concurred to by the employer and worker.

– Pay of a minimum of base pay (INFO # 1), the appropriate Colorado or regional minimum wage, and all made overtime earnings without impermissible reductions from their wages;.

– Pay of all made earnings without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements much of Colorado’s wage and hour and other kinds of labor statutes and labor guidelines, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules web pages for current and prior variations of key Colorado labor statutes and guidelines.

Published Guidance: The Division’s main kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally approved notifications, viewpoints, and explanations on different labor law topics; and.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you earnings, you can send your employer a written demand for payment of wages by mail, e-mail, text, or other electronic ways. A written demand might be sent to the employer at the same time a Labor Standards Complaint Form for unsettled salaries is filed with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements web page.

Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is gotten and examined, a letter explaining the nature of the problem and the quantities alleged to be owed is sent out to the company. Investigations Launched by the Division (” Direct Investigations”): The Division may perform employer-wide direct investigations of potential offenses of Colorado wage and hour law. If you would like to submit a private claim for unpaid incomes, you need to submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements webpage. To appeal a direct examination citation or several Notices of Assessment, an alleged employer might send a Direct Investigation Appeal Form.
